These General Terms of Sale govern the sale of the products ("Products" and/or "Product") offered on the website mialmart.com ("Website"). The products marketed on the Website are offered and sold by MIALMART di Prendin Annalisa, VAT no. 05600060288, Padua (Italy).

Scope of the General Terms of Sale

1.1 All orders placed through the Website are governed by these General Terms of Sale, drawn up in accordance with the legislation in force on distance contracts and electronic commerce. By submitting an order you declare that you have read, understood and accepted these General Terms of Sale. 1.2 The purchase of the Products through the Website is permitted only to persons ("User" and/or "Users") who are at least 18 years old and who qualify as consumers, meaning natural persons acting for purposes unrelated to any business, commercial, professional or craft activity they may carry out. 1.3 These General Terms of Sale apply exclusively to deliveries of Products to be made within the territory of the European Union. 1.4 By browsing the Website, the User agrees to be bound by the conditions of use and by the rules applied by MIALMART di Prendin Annalisa regarding privacy on the Internet. 1.5 MIALMART di Prendin Annalisa reserves the right at any time to amend these General Terms of Sale by publishing a new version on the Website. The applicable General Terms of Sale are those in force at the time the order is submitted.

Orders

2.1 By submitting an order through the Website, the User undertakes to purchase the Product ordered, in accordance with these General Terms of Sale. 2.2 MIALMART di Prendin Annalisa reserves the right to refuse or cancel orders received in the following alternative cases: i) where the User is involved in ongoing legal proceedings and/or has previously breached in any way the conditions and/or terms of a prior purchase order; ii) where the User has been involved in fraud of any kind, in particular relating to the use of credit cards and/or other payment methods; iii) where the User has provided false and/or incomplete identifying data; iv) where MIALMART di Prendin Annalisa is aware of other factors that exclude or reduce the reliability and/or good faith of the User. 2.3 To conclude the contract for the purchase of one or more Products, the User must proceed according to the instructions that appear on the Website; the contract is deemed concluded when MIALMART di Prendin Annalisa sends the User an email containing the order confirmation. 2.4 The data recorded by MIALMART di Prendin Annalisa through the Website constitute proof of the order and of the sales contract. 2.5 Should the purchase price not be paid by the User, or should successful payment not be confirmed, the purchase contract shall be deemed automatically terminated pursuant to and for the purposes of Article 1456 of the Italian Civil Code. 2.6 MIALMART di Prendin Annalisa will ship the Products only after receiving confirmation of successful payment of the price by the User; the delivery terms run from that date.

Availability and features of the Products

3.1 The availability of the Products is continuously monitored and updated; however, since the Website is visited by several users, even simultaneously, it may happen that one or more Products are temporarily unavailable. 3.2 Should the Product be unavailable, MIALMART di Prendin Annalisa will notify the User by email; in that case, the User will have the right to immediately terminate the contract and MIALMART di Prendin Annalisa will refund the User all sums received. Alternatively, the User may opt for the following solutions: i) where restocking of the Product is possible, confirm the intention to purchase it under the new delivery terms communicated by MIALMART di Prendin Annalisa; ii) where restocking of the Product is not possible, communicate the intention to purchase a different Product, subject to a debit or credit adjustment to the User based on the value of the replacement Product. 3.3 The images and photographic representations of the Products on the Website faithfully reproduce the original Products. However, variations are always possible due to the technical features of the device used by the User. Images and colours may not correspond exactly to the real ones due to the Internet browser and/or monitor and/or device used by the User. In such cases, MIALMART di Prendin Annalisa shall not be liable in any way.

"Custom Made" Products

4.1 Through the Website, the User is offered some possible forms of customisation (by way of non-exhaustive example: adding figures and/or initials on the Product; a personalised combination of colours) of certain Products ("Custom Made Products"). 4.2 In relation to each Custom Made Product, MIALMART di Prendin Annalisa will inform the User of the different delivery times. 4.3 In relation to Custom Made Products, the User's right of withdrawal is excluded.

Prices, shipping costs and payment methods

5.1 All prices of the Products published on the Website are expressed in Euros and already include VAT. 5.2 Shipping costs within the Italian territory and the European Union are borne by MIALMART di Prendin Annalisa and included in the prices indicated above.

Delivery

6.1 All orders confirmed by MIALMART di Prendin Annalisa will be delivered to the shipping address specified by the User when the order is submitted. 6.2 Deliveries can be made exclusively within the Italian national territory and the territory of the European Union countries. 6.3 For any requests for sales and deliveries to be made outside the territory of the European Union, in relation to which MIALMART di Prendin Annalisa assumes no prior commitment, the User may send a non-binding email to mialmart@mialmart.com. 6.4 The delivery times shown on the Website and in the order confirmation, equal to 4 weeks from receipt of payment, are to be understood as indicative; MIALMART di Prendin Annalisa shall not be liable for minor delays. 6.5 The delivery obligation is fulfilled by transferring physical availability, or in any case control, of the Products to the User. 6.6 It is the User's responsibility to check the condition of the Products delivered. Without prejudice to the fact that the risk of loss or damage to the Products, for causes not attributable to MIALMART di Prendin Annalisa, passes to the User when the latter, including through a designated person, takes physical possession of the Products, the User is advised to check the integrity of the packaging and the number of Products received and, where possible, to note any anomalies on the carrier's transport document.

Right of Withdrawal

7.1 With the exception of the Custom Made Products referred to in Article 4 above, the User, as a consumer, has the right to withdraw from the contract by written notice — preferably sent by email to mialmart@mialmart.com — within fourteen (14) calendar days from the day on which the User, including through third parties designated by them, acquired physical possession of the Product. 7.2 Following the exercise of the right of withdrawal, the User must return the Products to MIALMART di Prendin Annalisa, without undue delay and in any case no later than fourteen (14) calendar days from the withdrawal notice. 7.3 The costs and charges of returning the Products to MIALMART di Prendin Annalisa are borne entirely by the User, who assumes full responsibility for them. 7.4 The Products must be returned to MIALMART di Prendin Annalisa. 7.5 By reason of the withdrawal and upon receipt of the returned Products from the User, MIALMART di Prendin Annalisa will refund all payments received from the User, without undue delay and in any case no later than fourteen (14) days from the day on which it was informed of the withdrawal decision. 7.6 The Products must be kept and inspected with normal care, and returned intact, complete in every part, perfectly working and functional for their purpose, together with all accessories and instruction leaflets, with identification tags and labels — where present — still attached to the Products, intact and not tampered with, perfectly suitable for their intended use, free of signs of wear or dirt. The Products must also be returned in their original packaging. 7.7 Withdrawal applies to the Product in its entirety; it therefore cannot be exercised in relation to parts and/or accessories of the Product. 7.8 Should the withdrawal not be exercised in accordance with the above provisions and, more generally, with the applicable legislation, it will not result in termination of the contract and, consequently, will not give rise to any refund. MIALMART di Prendin Annalisa will notify the User within 5 working days of receipt of the Product, rejecting the withdrawal request. The Product, if already received by MIALMART di Prendin Annalisa, will remain with the latter available to the User for collection, which must take place at the expense and under the responsibility of the User.

Applicable law and jurisdiction

8.1 These General Terms of Sale are governed by Italian law. 8.2 The competent court is that of the User's place of residence or domicile.
